Live as Minilanders in a LEGO® Beach Home!

OVERVIEW:   

LEGOLAND California Resort (“LEGOLAND”) is auctioning off the opportunity for one family of up to ten (10) individuals to have “Minilanders” created in their image and installed as “residents” of an awesome LEGO beach house in MINILAND San Diego. 

Real estate agent Allie Lutz has the exclusive listing on the beach house and is offering the highest bidding individual the opportunity to have their personalized Minilanders “live” in the beach house for as long as the beach house remains in LEGOLAND California Resort’s MINILAND San Diego.  Proceeds from the auction will benefit the Merlin’s Magic Wand charity. 

ELIGIBILITY:

The Minilander Residents in LEGO Beach Home Auction (“the Auction”) is open to all individuals age 18 and over residing in the United States. Any bidder who is not age 18 or over and/or who resides outside the United States will not be eligible to be the Successful Bidder. 

HOW TO BID:

There is no purchase necessary to bid in the Auction. In order to submit a bid, an eligible bidder must visit https://www.charityauctionstoday.com/bid/2361 and follow the instructions and/or terms and conditions listed there regarding the submission of a bid to “Live in Minilander form in a LEGO Beach House.”  Among other things, eligible bidders must provide valid credit card information along with their initial bid and must acknowledge that LEGOLAND is authorized to charge their credit card for the full amount of their bid if it is the highest. Eligible bidders may submit as many bids and/or increase their bid as often as they like within the Auction Period (defined below) as provided in the Auction instructions and/or terms and conditions. All bids become the property of LEGOLAND and may be used for, among other purposes, public relations and marketing collateral, or posted to the web or social media, at LEGOLAND’s sole discretion and without additional compensation or authorization.

WHEN TO BID:

Bids will be accepted from 6:00a.m. (Pacific Time) on July 24, 2023 to 11:59 p.m. (Pacific Time) on August 7, 2023 (“the Auction Period”).   

NOTIFICATION OF HIGHEST BIDDER:

One (1) highest bidder (“the Successful Bidder”) will be selected from the eligible bids received during the Auction Period. The selection of the Successful Bidder, and the criteria used in selecting the Successful Bidder, are within the sole discretion of LEGOLAND, and the decisions of LEGOLAND are final. The Successful Bidder’s credit card will be charged for the full amount of his/her bid immediately following the end of the Auction Period. Thereafter, the Successful Bidder must return to LEGOLAND, within the timeframe set by LEGOLAND, signed and completed proof of age and eligibility, and consent and release forms, including written consent to the Successful Bidder and his/her applicable family members being filmed and photographed and their likenesses being used for, among other things, public relations and marketing collateral. The Successful Bidder must also commit to attend the presentation ceremony where the Minilanders created in the image of the Successful Bidder and up to nine (9) other members of his/her family will be unveiled and installed as “residents” of a LEGO beach house in LEGOLAND California Resort’s MINILAND San Diego. Once acceptance is complete, the Successful Bidder will be eligible to receive the Auction Prize identified below. Failure to so accept will result in the Successful Bidder’s selection and Auction Prize being forfeited, and an alternate Successful Bidder may be selected. 

AUCTION PRIZE: 

LEGOLAND will create Minilander figures in the image of the Successful Bidder and up to nine (9) other members of the Successful Bidder’s family and will install those Minilanders as “residents” of a LEGO beach house in LEGOLAND California Resort’s MINILAND San Diego, where they will “live” for a period as long as the beach house remains in Miniland San Diego (“the Auction Prize”).  LEGOLAND reserves sole, complete, and absolute control and discretion over the design, creation, likeness, timing, and placement of each Minilander.    

MISCELLANEOUS:

Employees of LEGOLAND, its affiliates, subsidiaries, advertising and promotion agencies, and the immediate families and/or those living in the same household of each are not eligible.  Void where prohibited by law.  All federal, state and local laws and regulations apply. All federal, state and local taxes are the sole responsibility of Successful Bidder. LEGOLAND reserves the right to substitute the Auction Prize for a prize of equal or greater value. No substitution, barter, transfer or assignment of prizes permitted, except by LEGOLAND in its sole discretion. All other costs associated with the Auction Prize not stated herein as being awarded are the responsibility of the Successful Bidder. For the avoidance of doubt, among other things, selection as the Successful Bidder does not entitle the Successful Bidder to free or discounted LEGOLAND admission or parking, nor does selection as the Successful Bidder entitle the Successful Bidder to any right, title, or interest in any portion of LEGOLAND, the LEGOLAND California Resort’s MINILAND San Diego, or the beach house, nor any right, title, or interest in any LEGO Minilander  figure. All details of the Auction Prize not specified herein are at the sole discretion of LEGOLAND. By participating in the Auction, bidders agree that neither LEGOLAND nor its affiliates, subsidiaries, distributors, or agencies, nor any of their respective employees, shareholders, directors or officers, will have any liability whatsoever for any injuries, losses, harm, damage, cost, or expense, including, without limitation, any personal injury, arising from or in connection with participation in the Auction or the acceptance, possession, or use of any prize. The Successful Bidder acknowledges that neither LEGOLAND nor its directors, employees, or agents, have made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, or fitness for a particular purpose. By participating in the Auction, bidders agree to be bound by these Terms and Conditions, the decisions of LEGOLAND, and the terms and conditions of the Auction. This promotion is sponsored by LEGOLAND California Resort, One LEGOLAND Drive, Carlsbad, CA  92008. Submission of a bid in the Auction constitutes permission for LEGOLAND and its agencies to use bidder’s name and/or likenesses for purposes of advertising and trade without further compensation, unless prohibited by law.

LEGOLAND reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the bidding process or the operation of the Auction; violates these Terms and Conditions or the terms and conditions of the Auction; acts in an unsportsmanlike or disruptive manner: or acts with intent to annoy, abuse, threaten or harass any other person. LEGOLAND is not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, by any of the equipment or programming associated with or utilized in the Auction which may limit the ability to participate, or by any human error which may occur in the processing of the bids and administration of the Auction. LEGOLAND reserves the right to cancel, terminate or modify the Auction if it cannot be completed as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, technical failures, or corruption of any sort. In such event, LEGOLAND will select a Successful Bidder in a random drawing from among all eligible bids received prior to cancellation.   

LEGOLAND reserves the right to vet all potential bid winners to ensure the content portrayed in public spaces, including the internet and social media platforms, aligns with our values.

GOVERNING LAW:

The Auction and these Terms and Conditions will be governed by the laws of the State of California and those courts located in San Diego County, California shall have exclusive jurisdiction in the event that any dispute arises regarding the Auction or a prize, without giving effect to any choice of law or conflict of law rules. Any and all disputes shall be brought individually without resort to any form of class action. Under no circumstances will any bidder be permitted to obtain any award for, and bidders hereby waive all rights to claim, punitive, incidental or consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased are hereby waived. In no event shall a bidder be entitled to receive attorney fees or other legal costs or expenses.
